1. Acceptance of Terms

By accessing or using the website oberoitech.com or any services provided by OberoiTech ("Company", "we", "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services.

2. Services

OberoiTech provides custom software development services including website development, mobile application development, e-commerce solutions, CRM/ERP development, and digital extension products. All services are subject to a separate written agreement or scope of work signed between the client and OberoiTech.

3. Intellectual Property

All content on this website — including but not limited to text, graphics, logos, images, and code — is the property of OberoiTech and is protected by applicable intellectual property laws.

Custom software developed for a client becomes the client's intellectual property upon full payment as specified in the project agreement. Pre-existing proprietary tools, libraries, or frameworks used in development remain the property of OberoiTech.

4. Digital Products (Extensions)

• Extension products are sold as digital downloads and are licensed (not sold) to the purchaser for use on a single installation unless stated otherwise.
• You may not redistribute, resell, sublicense, or share extension products.
• We reserve the right to revoke a licence if these terms are violated.
• All extension sales are final. See our Refund Policy for exceptions.

5. User Responsibilities

You agree not to:

• Use the website for any unlawful purpose
• Attempt to gain unauthorised access to any part of our systems
• Transmit any harmful, offensive, or disruptive content through our forms
• Misrepresent your identity or affiliation when contacting us

6. Project Agreements & Payments

Custom development projects are governed by a separate Statement of Work (SOW) or project agreement. Payment schedules, milestones, and deliverables are defined in that agreement. In the absence of a written agreement, payment terms are 50% upfront and 50% on delivery.

Late payments may incur interest at 2% per month on the outstanding amount.

7. Limitation of Liability

OberoiTech's total liability for any claim arising out of or relating to its services shall not exceed the amount paid by you for the specific service giving rise to the claim in the 3 months preceding the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities.

8. Disclaimer of Warranties

Our website and digital products are provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be error-free or uninterrupted.

9. Third-Party Links

Our website may contain links to third-party websites. These links are provided for convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in India.

11. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.
